The deadline for the groundbreaking General Data Protection Regulation (GDPR) compliance is May 25, 2018. If your business holds any data on residents of any of the 28-member states of the European Union, you had better get acquainted with the demands of GDPR.
The legislation seeks to protect personal data of EU residents by regulating how organizations collect, store and process data. Your company may be affected, as long as you have a web presence in the EU even if you aren’t based or don’t sell directly in Europe. A US company that markets a product/service to a European audience must, therefore, comply with the updated legislation.
The looming deadline certainly creates challenges for all US businesses targeting EU citizens to change their data strategies and infrastructure to ensure compliance. Failure to implement the changes will attract hefty fines of up to 4% of annual global revenue or €20 million – whichever is higher, lawsuits or even immense business losses due to the damaged reputation. Getting your data operations to comply is the only reasonable approach here.
It’s important to note that the customer doesn’t need to make a financial commitment for the scope of the legislation to apply. If the organization collects personal data (including email address, name, IP address, phone number, etc.) of EU residents, then it’s subject to the requirements of the GDPR.
Will GDPR Affect Your Digital Marketing?
If your online marketing is “generic” and not EU targeted, GDPR does not apply. So, let’s say, for example, someone in Germany uses Google, finds an English-language webpage written for U.S. e-commerce consumers and proceeds to fill out an online form. Such a website won’t need to adhere to the GDPR guidelines.
To stay in the clear, you’ll need to assess the extent to which your business is aiming its activities at EU residents to determine if GDPR applies. Make sure you consult with your IT director, marketing director, or data management company before letting your guard down.
